Supreme Court Answer

What is Judicial Review and why is it important?

The power of judicial review is the power of the US Supreme Court to determine whether a law is constitutional and struck it down as invalid if deemed unconstitutional. It was introduced into the American legal system by the decision in Marbury v. Madison. It is important because it grants greater institutional strength to the judiciary as a branch of the government. Before the power was introduced, the judiciary was deemed as the least dangerous of the branches. With judicial review, however, it can overturn the acts of the executive and the legislative branch with the exercise of its function of interpreting and construing the Constitution
