- Capital punishment does not violate the US Constitution because the jury is given adequate time and guidance as to the exercise of its discretion.
Opponents claim that capital punishment is questionable as to the fair administration of the judgment. However, the jury takes their time to study and evaluate the issues surrounding the crime to determine that capital punishment is the proper punishment for the criminal.
