Week 8 lecture:

This week you will be able to understand the different types of personal representative, understand the procedures a personal representative has in the formal probate procedures and recognize the assistants role to the personal representative in the duties of estate administration.  Public administrators are appointed by a court if the personal representative does not assume the role or can’t. Paralegals and estate administrators can establish a ticket system to organize the documents received and the ones that are still needed.  The place and date of death is important as this information goes on the tax return.  The highest degree of care and integrity is required of the personal representative. Obtaining the death certificate is also critical.

Can the personal representative decline this role? If so what will happen to the administration of the estate?

If a person does not want to execute the role of a personal representative, he/she does not need to permit the court to assign the role to him/her. If this happens, the backup executor would be appointed if the creator of the will named one
